1.1. These terms and conditions for the purchase and sale of goods (hereinafter – the “Terms”) are a mandatory document establishing the rights and obligations of the Buyer and the Seller, the procedure for purchasing, payment, delivery and returns, as well as other matters related to purchases in the vynoklubas.lt online store.
1.2. By accepting the Terms (by ticking the box “I agree with the purchase terms”), the Buyer confirms that they have read them and undertakes to comply with them.
1.3. The Seller has the right to amend or supplement the Terms at any time. The version in force at the time the order is placed shall apply.
1.4. Purchases on vynoklubas.lt may be made by legally capable natural persons aged 20 or older, as well as legal entities.
2.1. Personal data is processed in accordance with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and other applicable legal acts.
2.2. The Buyer has the right to access their data, rectify, erase, restrict processing, and to lodge a complaint with the State Data Protection Inspectorate.
2.3. vynoklubas.lt processes the data provided by the Buyer for order fulfilment, payment administration, business planning and analysis, and where necessary may transfer such data to third parties when required to fulfil the order.
2.4. Data is protected against loss, unauthorised use, or alteration.
3.1. The agreement is deemed concluded from the moment the Buyer creates a shopping cart and clicks the “Buy” button.
3.2. vynoklubas.lt does not additionally notify of acceptance to conclude the agreement – the order is considered confirmed from the moment its fulfilment begins.
4.1. The Buyer has the right to purchase goods on vynoklubas.lt in accordance with the procedure established.
4.2. The Buyer has the right to withdraw from a distance purchase–sale agreement by notifying the Seller in writing (by email) within 14 days from the delivery of the goods, as provided for in the Civil Code of the Republic of Lithuania and Directive 2011/83/EU.
4.4. The Buyer may exercise the right of withdrawal only if the goods have not been damaged, their appearance has not substantially changed, and they have not been used.
5.1. The Buyer must accept the goods and pay the agreed price.
5.2. If the registration details change, the Buyer must update them.
5.3. The Buyer must safeguard their login details and, if lost, inform the Seller using the contacts provided.
5.4. By using the website, the Buyer undertakes to comply with these Terms and the legal acts of the Republic of Lithuania.
5.5. If the Buyer refuses to accept the delivered goods without a valid reason, the Buyer shall cover the delivery costs.
6.1. If the Buyer breaches their obligations or attempts to harm the website’s security, the Seller may restrict or suspend access.
6.2. In the event of significant circumstances, the Seller may temporarily or permanently suspend the operation of the website.
6.3. The Seller may cancel the order if the Buyer fails to pay on time or does not collect the goods.
6.4. If payment in cash upon delivery is selected, a fee of €3.00 applies.
6.5. The Seller may refuse to fulfil the agreement if goods are out of stock or if the agreement was concluded by a person who has no right to conclude it.
6.6. Purchased tickets and gift vouchers are non-refundable and non-exchangeable.
7.1. The Seller ensures the possibility to use vynoklubas.lt services under the established conditions.
7.2. The Seller delivers the ordered goods to the address specified by the Buyer.
7.3. If the Seller is unable to deliver the ordered goods, the Seller offers an equivalent alternative. If the Buyer refuses it, the money is refunded within 3 business days.
7.4. The Seller respects the Buyer’s privacy and processes personal data only for lawful purposes.
8.1. Prices are indicated in euros including VAT. vynoklubas.lt reserves the right to change prices in the event of changes in taxes or other applicable charges.
9.1. Goods are delivered by the Seller or a courier authorised by the Seller.
9.2. The usual delivery time is 1–3 business days if the item is in stock. In exceptional cases, the delivery time may be longer.
9.3. The Buyer must provide an accurate delivery address and ensure that the person receiving the goods is at least 20 years old.
9.4. The ordered goods may be collected free of charge at Vyno klubas stores: Stumbrų g. 15, Vilnius, and Liepų g. 20, Klaipėda.
9.5. Upon delivery, the Buyer checks the condition of the parcel together with the courier. After signing the delivery note, the parcel is considered received in good condition.
9.6. If the order includes alcoholic beverages, delivery is carried out only during the time permitted under the Law on Alcohol Control of the Republic of Lithuania.
10.1. The characteristics of each product are specified in its description.
10.2. Differences in colour or shape may occur due to display settings; therefore, this is not considered a defect.
10.3. Goods are sold so that the Buyer can use them until the end of their shelf life.
10.4. Products with a manufacturing defect (e.g., cork taint in wine) may be returned within 3 business days. If the defect is confirmed, the product will be replaced with the same or a similar product.
11.1. The Buyer is responsible for the accuracy of the provided information and for confirming their age (at least 20 years old).
11.2. The Buyer is responsible for actions performed using their account.
11.3. The Seller is not liable if the Buyer did not familiarise themselves with the Terms despite having the opportunity to do so.
11.4. If the website contains links to other pages, the Seller is not responsible for the content provided on those pages.
11.5. In the event of damage, the party at fault compensates the other party for direct losses.
12.1. The Seller sends notices to the email address provided by the Buyer during registration.
12.2. The Buyer contacts the Seller using the contacts indicated on the website.
13.1. The legal relations arising on the basis of these Terms shall be governed by the laws of the Republic of Lithuania.
13.2. Disputes are resolved through negotiations; if no agreement is reached, disputes shall be handled in accordance with the procedure established by the legal acts of the Republic of Lithuania.
